Terms of Use & Donation Terms

Welcome to Millie’s Gift, Inc. (“Millie’s Gift,” “MilliesGift.org,” “we,” “us,” “our”). By using this website or making a donation, you agree to these Terms. Please also review our Privacy Policy, Donor Privacy Policy, and Donation Refund Policy.

1) About Millie’s Gift & Eligibility

Millie’s Gift, Inc. is a U.S. 501(c)(3) public charity (EIN 33-4083071). Donations are tax-deductible to the extent allowed by law. You must be 18 or older to donate or create an account.

2) No medical advice

Information on this site is for general purposes only and is not medical advice. Always seek the advice of your physician or qualified provider. If you need immediate help, call 911 (U.S.) or your local emergency number.

3) Donations & receipts

  • Processing. Online gifts are processed by our PCI-compliant partners (Stripe, PayPal). We do not store card or bank details on our servers.
  • Receipts. We email a tax receipt for each gift and a year-end summary for recurring donors. If you received a benefit in exchange for your gift, the receipt will note the non-deductible amount.
  • Recurring gifts. Monthly gifts continue until you cancel. You can update or cancel at any time via your receipt link or by contacting donations@milliesgift.org.
  • Refunds. See our Donation Refund Policy for how to request a refund (generally within 15 days).

4) Gift Acceptance (how we handle different types of gifts)

The following incorporates and expands the clauses shown on our donation form.

  • Discretion to accept. Acceptance of any contribution, gift, or grant is at the discretion of Millie’s Gift. We will not accept any gift unless it can be used or expended consistently with our mission and policies.
  • Donor well-being. No irrevocable gift—whether outright or life-income—will be accepted if, under any reasonable set of circumstances, it would jeopardize the donor’s financial security. We do not provide tax, legal, or financial advice; donors should consult their own advisors.
  • Accepted gifts (standard). We accept donations of U.S. currency and publicly traded securities. Gifts of in-kind services may be accepted at our discretion.
  • Gifts requiring review. Certain gifts—such as real property, personal property, non-liquid or restricted securities, vehicles, cryptocurrency (if enabled), in-kind goods, or contributions from non-transparent sources or with unusual restrictions—must be reviewed and approved prior to acceptance due to the obligations or liabilities they may pose.
  • Use of restricted gifts. We respect donor intent for restricted gifts. If a restriction becomes impracticable or unnecessary, the Board may direct funds to the closest purpose consistent with the donor’s intent and our mission.
  • Valuation & acknowledgments. We provide acknowledgments meeting IRS requirements. Except for gifts of cash and publicly traded securities, we do not ascribe monetary value to receipts. Donors are responsible for substantiating the fair market value of non-cash gifts and for any required appraisals or forms.
  • Anonymity. We honor requests to remain anonymous. Information about anonymous donors is shared internally only with staff or agents who need to know to process the gift.
  • No commissions. Millie’s Gift does not compensate any third party (through commissions, finder’s fees, or similar) for directing a gift or a donor to the organization.
  • Compliance. We comply with applicable laws, including anti-money-laundering and sanctions screening, and may decline or return a gift when required.

5) Donor privacy

We do not sell or trade donor information. See our Donor Privacy Policy for details on how we use and safeguard donor data, recognition options, and anonymous giving.

6) User accounts & submissions

  • Accounts. If we offer accounts or donor dashboards, keep your credentials confidential. You are responsible for activity under your account.
  • Stories & media. If you submit text, photos, audio (e.g., heartbeat), or video, you represent you have rights to share them and grant us a non-exclusive, royalty-free license to use them for mission-related purposes (site, social, email, reports). You may withdraw permission for future use by emailing privacy@milliesgift.org; we will remove future use where feasible.
  • Sensitive content. Do not upload medical records or protected health information (PHI). For minors, a parent or legal guardian must provide consent.

7) Acceptable use

You agree not to misuse the site, attempt to gain unauthorized access, or upload unlawful, harassing, obscene, or infringing content. We may suspend or terminate access for violations.

8) Intellectual property

Site content (including the koala-heart mark, logos, text, and graphics) is owned by or licensed to Millie’s Gift and protected by law. You may link to our pages and share content for noncommercial, mission-related purposes with attribution. Other use requires prior written permission.

9) Third-party services

Our site integrates third-party services (e.g., payment processors, email platforms, analytics). Their terms and privacy policies govern your use of their services.

10) Disclaimers & limitation of liability

The site and services are provided “as is” without warranties of any kind. To the maximum extent permitted by law, Millie’s Gift is not liable for indirect or consequential damages arising from your use of the site or donations.

11) Governing law

These Terms are governed by the laws of the State of Utah, without regard to conflict of laws. Venue for any permitted action lies in state or federal courts located in Utah County, Utah.

12) Changes

We may update these Terms from time to time. The “Effective date” will reflect the latest version.
